If you do not agree with any of these terms, you are prohibited from using the True Blue Pharmacy Inc digital services.  BY USING THE True Blue Pharmacy Inc DIGITAL SERVICES, YOU AGREE TO THESE TERMS OF USE.

The mobile application and this website are owned and operated by True Blue Pharmacy Inc.  True Blue Pharmacy Inc reserves the right to change, modify, add or remove portions of these Terms of Use at any time and in its sole discretion.  Such modifications and additional terms and conditions will be effective immediately and incorporated into these Terms.  You are responsible for reviewing and becoming familiar with any such modifications.  Your continued use of True Blue Pharmacy Inc Digital Services following the posting of any changes to these Terms of Use means you accept and agree to such changes.  As long as you comply with these Terms of Use, True Blue Pharmacy Inc grants you a personal, non-exclusive, non-transferable, limited privilege to access and use True Blue Pharmacy Inc Digital Services.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SUCH LIMITATION SHALL NOT BE APPLICABLE TO YOU.

C. INDEMNIFICATION

You agree to indemnify and hold True Blue Pharmacy Inc, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, parent companies, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against True Blue Pharmacy Inc by any third party due to or arising out of or in connection to your violation of these Terms of Use, or with your use of the Digital Services.

D. GOVERNING LAW; DISPUTE RESOLUTION

If any part of these Terms of use is determined by a court of competent jurisdiction to be invalid or unenforceable, it will not affect any other provision of these Terms of Use, all of which remain in full force and effect.  You agree that all matters, including all disputes, relating to your access to or use of True Blue Pharmacy Inc information or services or of the True Blue Pharmacy Inc Services, including its Contents, will be governed by the laws of the State of Texas without regard to its conflicts of laws provisions.  You agree to the personal jurisdiction by and venue in the state and federal courts for Dallas County, Texas, and waive any objection to such jurisdiction or venue.

Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. In the event of any controversy or dispute between True Blue Pharmacy Inc and you arising out of or in connection with your access to or use of True Blue Pharmacy Inc information or the True Blue Pharmacy Inc Digital Services, including its Contents, the parties shall attempt, promptly and in good faith, to resolve any such dispute.  If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

E. FOREIGN CORRUPT PRACTICES ACT

User acknowledges that it is not the agent of True Blue Pharmacy Inc and represents and warrants that it has not, and covenants that it will not, pay anything of value to any government employee in connection with the resale of and products available through the True Blue Pharmacy Inc Digital Services.

F. ENTIRE AGREEMENT; SEVERABILITY; MISCELLANEOUS

These Terms of Use, our Privacy Policy, and our HIPAA Privacy Notice constitute the entire agreement between you and True Blue Pharmacy Inc and governs your use of the True Blue Pharmacy Inc Digital Services.  You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software.  If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.  True Blue Pharmacy Inc’s failure to enforce any right or provisions in these Terms of Use will not constitute a waiver of such or any other provision.  True Blue Pharmacy Inc will not be responsible for failures to fulfill any obligations due to causes beyond its control.  The section titles in the Terms are for convenience only and have no legal or contractual effect.

The True Blue Pharmacy Inc Digital Services are operated by True Blue Pharmacy Inc and its affiliates from its offices in the United States. You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your use of the True Blue Pharmacy Inc Digital Service.  All transactions through the True Blue Pharmacy Inc Digital Services are governed by Texas law, without giving effect to its conflict of law provisions.  Your use of the Services may also be subject to other laws.  Risk of loss and title for all electronically delivered transactions pass to the purchaser in Texas upon electronic transmission to the recipient.  No True Blue Pharmacy Inc employee or agent has the authority to vary these Terms of Use.

True Blue Pharmacy Inc may notify you with respect to the Services by sending an email message to your account email address or a letter via postal mail to your account mailing address, or by a posting via the True Blue Pharmacy Inc Digital Services.  Notices shall become effective immediately.

True Blue Pharmacy Inc reserves the right to take steps True Blue Pharmacy Inc believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of these Terms of Use.  You agree that True Blue Pharmacy Inc has the right, without liability to you, to disclose any registration data and/or account information to law enforcement authorities, government officials, and/or a third party, as True Blue Pharmacy Inc believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of these Terms of Use.

Nothing in these Terms of Use shall create or be deemed to create a partnership, agency, trust arrangement, fiduciary relationship, employment engagement, or joint venture between you and True Blue Pharmacy Inc, its affiliates, or other users.

B. GENERAL INFORMATION
